These Terms of Service ("Terms") govern your use of Paglify, an AI-powered landing page generation platform operated by CONAIS ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Paglify, you confirm that you:

  • Are at least 18 years old or have legal capacity to enter into contracts
  • Have read, understood, and agree to these Terms
  • Will comply with all applicable laws and regulations
  • Are authorized to act on behalf of any company or entity you register

2. Description of Services

Paglify provides an AI-powered platform for creating, optimizing, and managing landing pages. Our services include:

  • AI-generated landing page content and design
  • AI Consultant for marketing strategy guidance
  • Autonomous A/B testing and optimization
  • Analytics and conversion tracking
  • Form builder and lead capture
  • Hosting and deployment of landing pages

3. Account Registration

3.1 Account Creation

To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. Notify us immediately at security@paglify.com if you suspect unauthorized access.

4. Subscription Plans and Payment

4.1 Pricing

Our current subscription plans are:

  • Starter: $29/month ($23/month annual)
  • Pro: $79/month ($63/month annual)
  • Agency: $199/month ($159/month annual)

Prices are in USD and exclude applicable taxes (including German VAT/MwSt where applicable).

4.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law or stated in our refund policy
  • We may change prices with 30 days' notice for existing subscribers

4.3 Free Plan

We offer a free plan with limited features including a limited number of landing pages per month. No credit card is required. You may upgrade to a paid plan anytime to access more features.

4.4 Refund Policy

We offer a 30-day money-back guarantee for new subscriptions. Contact support@paglify.com within 30 days of your first payment for a full refund.

5. Acceptable Use Policy

You agree NOT to use Paglify to:

  • Create content that is illegal, harmful, threatening, abusive, or defamatory
  • Infringe on intellectual property rights of others
  • Distribute malware, phishing pages, or engage in fraud
  • Collect personal data without proper consent or legal basis
  • Send unsolicited communications (spam)
  • Violate any applicable laws, including GDPR, CAN-SPAM, or similar regulations
  • Attempt to reverse engineer, hack, or circumvent our security measures
  • Overload our systems or interfere with other users' access
  • Create landing pages for illegal products, services, or activities
  • Impersonate any person or entity

Violation of this policy may result in immediate account termination without refund.

6. Intellectual Property

6.1 Our Intellectual Property

Paglify, including its design, features, and technology, is owned by CONAIS. You may not copy, modify, distribute, or reverse engineer any part of our platform.

6.2 Your Content

You retain ownership of content you create using Paglify. You grant us a limited license to host, display, and process your content to provide our services.

6.3 AI-Generated Content

Content generated by our AI tools is provided for your use. You are responsible for reviewing and ensuring AI-generated content is accurate and appropriate. We do not guarantee the originality or legal compliance of AI-generated content.

7. Data Processing

When you collect personal data through landing pages created on Paglify:

  • You are the Data Controller for that data
  • We act as your Data Processor under GDPR
  • You must have appropriate legal basis and privacy notices
  • You must comply with GDPR and other applicable data protection laws

8. Service Availability

8.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible.

8.2 Modifications

We may modify, suspend, or discontinue features with reasonable notice. Significant changes will be communicated via email or in-app notification.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the fees you paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for lost profits, data loss, or business interruption
  • We are not liable for third-party content or services

These limitations do not apply where prohibited by law (e.g., gross negligence or intent under German law).

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your content or landing pages
  • Your violation of third-party rights
  • Your violation of applicable laws

11. Termination

11.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

11.2 By Us

We may suspend or terminate your account for:

  • Violation of these Terms or Acceptable Use Policy
  • Non-payment of fees
  • Extended inactivity (with prior notice)
  • Legal or regulatory requirements

11.3 Effect of Termination

Upon termination, you may export your data within 30 days. After this period, we will delete your data in accordance with our Privacy Policy.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 Jurisdiction

For business customers, disputes shall be resolved by the courts of Germany. Consumer customers may also bring claims in the courts of their country of residence.

12.3 Alternative Dispute Resolution

The European Commission provides an Online Dispute Resolution platform at:https://ec.europa.eu/consumers/odr

We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Paglify.

13.2 Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in effect.

13.3 No Waiver

Our failure to enforce any right does not waive our right to do so in the future.

13.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights to any affiliate or successor.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
